TERMS AND CONDITIONS OF USE - ENLIGHT RESEARCH & INNOVATION OBSERVATORY WEBSITE
The Terms and Conditions of Use (TCU) define the conditions under which all users may visit the ENLIGHT R&I Observatory website https://observatory.enlight-eu.org.
Preamble
The University of Bordeaux (a public higher education and research institution), on behalf of partners of the ENLIGHT European university alliance, coordinates a Research & Innovation observatory for the partners of the ENLIGHT alliance https://observatory.enlight-eu.org.
The ENLIGHT Research & Innovation Observatory (https://observatory.enlight-eu.org) is an information platform presenting the research and innovation capacities of and synergies between partners of the European university alliance ENLIGHT. It also collates a variety of Research and Innovation outputs and results of the ENLIGHT Alliance.
Article 1. – Purpose of the Terms and Conditions of Use
The ENLIGHT R&I Observatory website https://observatory.enlight-eu.org specifically allows users to:
- Discover the research and innovation capacities of and synergies between partners of the ENLIGHT European university alliance
- View a variety of Research and Innovation outputs and results of the ENLIGHT Alliance
Access to the website is subject to the User’s unreserved compliance with the present Terms and Conditions. Users are free to view the pages of the website https://observatory.enlight-eu.org.
Article 2. – Terms of use
2.1. Technical services
The University of Bordeaux has been assigned by the partners of the ENLIGHT European university alliance to ensure the computer and organizational resources enabling the technical implementation of the purpose stated in Article 1 above.
2.2. – Right of use
The content of the website is made available for private and non-exclusive use. This right of use includes the right to storage on a single screen and the right to reproduction in accordance with the provisions specified hereafter.
Website use is subject to the unreserved acceptance of the present Terms and Conditions of Use.
Article 3. – Commitments and liabilities
3.1. Commitments and liabilities of the University
a) Website operation and content
The technical architecture of the website https://observatory.enlight-eu.org is designed in such a way as to operate continuously in the aim of providing 7-day, 24-hour availability, with the exception of maintenance operations or due to exceptional technical reasons (pursuant to the terms of the present article), in addition to unforeseeable events or force majeure.
b) Limits of liability
On behalf of the partners of the ENLIGHT European university alliance, the University takes utmost care to publish useful, reliable and up-to-date information on the website. Information may be modified by the University without prior notice. These inclusions are nevertheless non-exhaustive and, notwithstanding the vigilance of the University’s departments, possible errors or omissions may occur. The information provided by the partners of the ENLIGHT Alliance is indicative in nature and does not excuse the User from conducting an additional and personalized analysis. The University cannot guarantee the accuracy, completeness or timeliness of the information published on the website https://observatory.enlight-eu.org. Consequently, users acknowledge that they use this information under their sole responsibility.
The User declares their knowledge and acceptance of the specifications linked to network computing and telecommunications. In particular, the University shall not be held liable in the following cases (non-exhaustive list):
- Disruptions to networks
- Hardware or software defaults
- Malicious activities, data theft, computer viruses, inadequate protection and safeguard
- Operating errors, hardware or software misuse
- Misuse or malicious use of data, texts, images, or information
- In all cases of force majeure, unforeseeable events, or any other causes beyond the University’s deliberate control
The University shall not be held liable under any circumstances for direct or indirect damage of any kind resulting from website use, and in particular material damage and data or program loss resulting from access to or use of the website or its associated sites.
The website may provide hypertext links to other sites, for the purpose of providing the User with a maximum of resources. The University shall not be held liable under any circumstances for erroneous information provided by the above-mentioned sites, insofar as it cannot control the full accuracy of their content.
The University shall not be held liable under any circumstances for the credit given by the User to information provided by a third party and relative to the partners of the ENLIGHT European university alliance.
3.2. Commitments and liabilities of the User
Users are solely responsible for their use of the website and its suitability to their needs.
Users expressly undertake not to use any elements of the website, notably in the framework of the purposes specified in Article 4.3 hereafter:
- On websites disseminating pornographic or xenophobic content, or more generally any information liable to fall within the scope of criminal provisions in effect
- Prejudicial to human dignity
- For commercial or advertising purposes
Article 4. – Intellectual property
4.1 General terms
The University of Bordeaux, acting in its own name and on behalf of the partners of the ENLIGHT European university alliance, non-exhaustively grants the User right of use to the whole website https://observatory.enlight-eu.org, subject to the present Terms and Conditions of Use.
No intellectual property right to the whole ENLIGHT Research & Innovation Observatory (https://observatory.enlight-eu.org) shall be transferred to users on provision of the service subject to the present Terms and Conditions of Use.
The University of Bordeaux guarantees that it holds the rights to the intellectual property enabling the implementation of the ENLIGHT Research & Innovation Observatory (https://observatory.enlight-eu.org) as specified in the present Terms and Conditions of Use, and this website https://observatory.enlight-eu.org is thus neither prejudicial to third party rights, nor constitutes a counterfeit of a pre-existing work.
The University, on behalf of the partners of the ENLIGHT European university alliance, is holder or assignee of rights pertaining to the website’s computer elements, such as software and computer codes, etc.
All elements collected or compiled on the website constitute a database. The partners of the ENLIGHT European university alliance co-hold the right of the producer of the database constituting the website, having contributed to its creation, verification and presentation. Any extraction, through permanent or temporary transfer of the total or a qualitatively or quantitatively substantial part of database content to another media, by any means and in any form whatsoever, without the express consent of the partners of the ENLIGHT European university alliance via the University of Bordeaux, is prohibited. This also applies to reuse, by providing public access to the total or a qualitatively or quantitatively substantial part of database content, in any form whatsoever.

The partners of the ENLIGHT European university alliance hold a right to use the domain name: https://observatory.enlight-eu.org
4.2. Use of website elements
a) Paper-based reproduction
The paper-based reproduction of pages from the present website is authorized, subject to the following conditions:
- Dissemination must be free of charge
- Documents must be reproduced in their entirety, without modification or alteration of any kind, and must retain all elements of the ENLIGHT alliance logo
- Explicit reference must be made to the website https://observatory.enlight-eu.org as the source and must specify that reproduction rights are reserved and limited.
This authorization does not apply to magazines or other media disseminating controversial, pornographic or xenophobic content, or content that in general may be deemed offensive to the general public.
b) Use via electronic means
The electronic use of all or part of the present website is authorized exclusively for partners of the ENLIGHT European university alliance and third parties having received the consent of the former. All other users may refer solely to content via the URL link to the website. (https://observatory.enlight-eu.org ).
This authorization does not apply to websites disseminating controversial, pornographic or xenophobic content, or content that in general may be liable for criminal prosecution or deemed offensive to the general public.
Any use for advertising or commercial purposes is excluded.
The breach of any of these operating rights constitutes an infringement of copyright liable to criminal prosecution.
Article 5. – Protection of personal data
5.1. General principles
The University of Bordeaux undertakes to comply with the regulations in effect applicable to the processing of Personal Data, and in particular European Parliament and Council Regulation (EU) 2016/679 (hereinafter the ‘GDPR’) and Law no° 78-17 of 6 January 1978 amended relative to computers, files and freedom (hereinafter the ‘Data Protection Act’).
The University of Bordeaux is responsible for the processing of Personal Data as defined by the GDPR. The University implements the organizational, material and computer measures to protect said data from non-authorized access and alteration.
All information and provisions relative to Personal Data protection is available in the Privacy Policy published on the https://observatory.enlight-eu.org website.
5.2. Data specific to website visits
During every visit to the website, cookies are placed on the User’s terminal (computer, tablet or smartphone, etc.). The purpose of these cookies is to record website browsing information.
In particular, they collect user data on searches, pages viewed and links used. They also help to optimize website service.
The User may choose to accept or refuse these cookies, with the exception of those strictly necessary to operate the website. The banner appearing on the home page enables the User’s overall acceptance or to manage their options.

Article 6. – Miscellaneous provisions
6.1. Partial non-validity
If one or more of the stipulations of the present Terms and Conditions of Use are deemed illegal or declared either wholly or partially invalid, pursuant to a law, regulation or definitive ruling by a competent jurisdiction, said stipulation(s) will be modified in accordance with the law or ruling. None of the other provisions of these General Terms and Conditions of Use will be affected, unless they have an intrinsic link to the illegal or invalid stipulation(s).
6.2. Non waiver
Failure of the University to take action against a breach by the User of any of the obligations referred to in these General Terms and Conditions of Use shall not be interpreted as a waiver of the obligation in question.
6.3. Modification of the Terms and Conditions of Use
The University reserves the right to modify the present Terms and Conditions of Use in any way it deems useful. The date of amendment shall be displayed with the Terms and Conditions of Use published on the website.
All use of the service further to the modification of the Terms and Conditions of Use implies the User’s full and entire acceptance of the updated Terms and Conditions.

Article 8. – Disputes and applicable law
The present Terms and Conditions of Use are governed by French law.
In the event of a dispute relative to the execution or interpretation of the present Terms and Conditions of Use, the University and the User agree to seek an amicable settlement before bringing the matter before the competent courts in the University’s place of residence.
